Money Train Terms and Conditions
1.
The Money Train competition (the “Competition”) is organized by Zambia
National Broadcasting Corporation (ZNBC).
2.
By entering the Competition you agree to be bound by these terms and
conditions (the “Terms and Conditions”). ZNBC reserves the right to
amend these Terms and Conditions at any time without notice and by
entering the Competition you agree to be bound by the Terms and
Conditions in force at that time.
3.
The Terms and Conditions in force from time to time will be posted on
this website. Any instructions for entry given by ZNBC shall also form
part of the Terms and Conditions.
4.
Participation is only possible during the hours of broadcast of “The
Money Train” programme. Any entries received after the programme has
been broadcast will be discarded.
5.
Except as further set out in these Terms and Conditions the Competition
is open to all Zambian residents aged 18 years
or older and by entering the Competition you warrant that you are
resident in Zambia and are 18 years or older and not within any of the
classes of persons listed in paragraph 6 below. You understand that ZNBC
will be entitled to withhold any Prize if you misrepresent in any way
your eligibility to enter the Competition.
6.
The following persons may not enter the Competition and may not win the
prize:
a). Employees of Zambia National Broadcast Corporation.
b). Employees
of TIM w.e. Zambia and WT Play.
c). In relation to any of the people listed above, their immediate
families and household members.
7.
ZNBC will have sole and absolute discretion as to whether to accept any
entry. ZNBC reserves the right to exclude anyone from the Competition in
the event that ZNBC believes, at ZNBC’s sole discretion that such a
person may be using technology to gain an unfair advantage over other
contestants.
8.
To enter the competition you have to send an SMS to 3477. The person who
actually answers the questions correctly during the live show shall be
considered the winner of the prize on offer regardless of whose phone
line is used to send the SMS.
9.
Sending one SMS will cost K 3,000.
10.
If your SMS is selected to play, the ZNBC production team will call your
mobile number and will put your call “on air” to answer the question.
11.
Once you send one SMS you become eligible to participate in the show in
the event that your mobile line is selected in accordance with clause 12
below. To increase your chances of your number being selected, you can
send as many SMS as you wish. Sending one SMS does not guarantee
participation on the game.
12.
The SMS register will enter the system in order of entry (minute and
seconds) and from every 50 SMSes, one shall be selected. The telephone
number selected will be contacted to enter the competition.
13.
ZNBC reserves the right to decide the number of SMSses to be received
before selecting and calling a participant.
14.
All SMS may be recorded for security and/or training purposes.
15.
ZNBC accepts no responsibility where any call back is not connected to
your phone, howsoever caused.
16.
If you are unavailable to take up the prize, ZNBC reserves the right to
award the prize to another winner.
17.
On the day of the show or on the day after the show, the winner will be
contacted by ZNBC and will be asked to provide Name, Address and
Identity card number. To receive the prize, the winner will have to come
to ZNBC facilities and show proof of original identity documents.
Photocopies shall not be accepted. If the winner lives in other district
of Zambia other than Lusaka, they will have to go to ZNBC facilities in
their provincial capital to receive their prize. Those in Lusaka can
collect their prizes from ZNBC at Mass Media Complex on Alick Nkhata
Road. Instructions will be given at the time the winner is called by
ZNBC to award the prize. Prizes will only be made available in the name
of the Competition entrant.
18.
The prize is paid by ZNBC and the award-winner shall sign a statement
proving he received the prize. Prize will be paid within a maximum of 30
days.
19. ZNBC may withdraw or cancel the Competition for any reason
and at any time and may change the prize to a prize of similar value.
ZNBC is under no obligation to offer refunds, but may do so at its sole
discretion.
20.
The winner of the Competition acknowledges that their name may be
publicized.
21.
ZNBC, its suppliers, their group companies and sub-contractors do not
accept any responsibility whatsoever for (i) any technical failure or
malfunction or any other problem in any telephone network or line,
system, server, provider or otherwise which may result in any message
being lost or not properly recorded, or (ii) traffic congestion or other
capacity issues which may result in a message not being able to get
through or a message not being recorded. The Competition is provided “as
is” and, to the fullest extent permitted by law, ZNBC excludes all
warranties and liability(whether express or implied) regarding the
Competition or the prize. In no event will ZNBC’s liability to you
exceed the cost of your entry, save that nothing limits ZNBC’s liability
for death or personal injury as a result of its negligence.
22.
Any personal data collected will be used solely in accordance with
appropriate Zambian Laws. Please see ZNBC’s privacy policy for further
details.
23.
In the event of any dispute regarding the Competition, and subject to
the constitution of Zambia, the decision of ZNBC shall be final and
binding and no correspondence or discussion shall be entered into with
you or any person acting on your behalf.
24.
ZNBC may disqualify you from winning the prize if it has reasonable
grounds to suspect you may be in breach of these Terms and Conditions
and/or your participation in the Competition may be fraudulent or
otherwise unlawful (including but not limited to the use of technology
which enables a contestant to evade charges when entering the
Competition by the Premium Rate Telephone Number). ZNBC may request you
to provide proof of your eligibility to enter the Competition or your
compliance with these Terms and Conditions before being entitled to a
prize.
25.
These terms and conditions shall be governed by Zambian law and shall be
subject to the exclusive jurisdiction of the Zambian courts.
26.
All prizes must be collected
within 30 days of notification. All those who will not collect within 30
days will forfeit the prizes
