The Constitutional Court has adjourned the case in which UPND Munali Constituency losing candidate Doreen Mwamba has challenged the election of Professor Nkandu Luo as duly elected member of parliament.
This was after the court ordered High Court Judge Edward Musona to view a video that had been produced as evidence before him and confirm its authenticity.
The Constitutional Court further guided that the video should be viewed in the presence of all the parties.
Judge Musona who handled the matter at the High Court is expected to give feed back to the Constitutional Court by March 29th, 2018.
Constitutional Court Judge justice Enoch Mulembe sitting with other judges observed that this decision has been taken in the interest of justice.
In this matter Professor Nkandu Luo had argued that the video should not be presented but the petitioners argued to the contrary saying the video should be part of evidence.
The Munali seat was nullified by the High Court on account of electoral malpractice.
This forced Professor Luo to appeal the High Court’s decision’s in the Constitutional Court.
